Radha Govind Dham (“RGD”) owns the website swamimukundananda.org (the “Website”). The Website is operated and maintained by JKYog Bhakti Private Limited (“JB Private Limited,” “JBPL,” “we,” “us,” or “our”). The spiritual teachings, discourses, videos, podcasts, books, and other content available on the Website (the “Content”) are owned by RGD and Jagadguru Kripalu Yog Trust (“JKYog”). The sale of books, SM Specials, and SM Courses through the Website is carried out by JBPL.

This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit or use the Website and its associated services, such as event registration, orders for books and SM Specials, SM Courses, newsletters, and live interactive sessions (collectively, the “Services”), in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the Digital Personal Data Protection Rules, 2025 (“DPDP Rules”).

By accessing or using the Website, you agree to the collection and use of information in accordance with this Privacy Policy.

This notice is provided independently of any other information you may receive from us and is available in English. If you would like to access this notice in a language specified in the Eighth Schedule to the Constitution of India, please contact us using the details in Section 14.

1.1 Information You Provide to Us

We may collect personal information that you voluntarily provide when you:

  • Register for an event, retreat, satsang, or program (e.g., name, email address, phone number, mailing address, city/country of residence, and emergency contact details where applicable);
  • Place an order for books or subscribe for SM Specials/SMExclusive (e.g., name, billing and shipping address, email, phone number, and payment information);
  • Enroll in or purchase an SM Course (e.g., name, email address, phone number, and payment information);
  • Subscribe to our newsletter or mailing list (e.g., email address, name);
  • Submit a question through "Ask Live," contact forms, comments, or any interactive feature (e.g., name, email, and the content of your submission);
  • Download or register on the Swami Mukundananda App (e.g., account credentials, profile information);
  • Contact us directly via email, phone, or postal mail.

We do not knowingly collect more information than is necessary for the specified purpose for which it is collected.

1.2 Information Collected Automatically

When you visit the Website, we and our service providers may automatically collect certain information, including:

  • IP address, browser type and version, device type, operating system, and general location (city/country);
  • Pages viewed, time spent on pages, referring/exit pages, and click-stream data;
  • Course engagement and progress data, such as lessons or videos viewed, quizzes completed, and login history, if you enroll in an SM Course;
  • Cookies, web beacons, and similar tracking technologies (see Section 4 below).

1.3 Information from Third Parties

We may receive information about you from third parties such as payment processors, event partners or venue hosts (for example, hosting temples or retreat centers), and analytics or advertising providers, to the extent permitted by their own privacy policies and applicable law.

How We Use Your Information

We use the information we collect for purposes including:

  • Processing and fulfilling orders for books and SM Specials, including payment, shipping, and customer support, as the business owner of that sales activity;
  • Registering you for events, retreats, and programs, and communicating logistical details;
  • Providing access to and administering SM Courses, including tracking your progress and, where applicable, issuing certificates of completion, as the business owner of that sales activity;
  • Sending newsletters, spiritual content updates, event and course announcements, and promotional communications (with an option to opt out at any time);
  • Responding to questions submitted via "Ask Live," contact forms, or customer support inquiries;
  • Operating, maintaining, and improving the Website and Services, including analytics and troubleshooting;
  • Maintaining the security and integrity of the Website and preventing fraud or misuse;
  • Complying with applicable legal, tax, and regulatory obligations.

Legal Basis for Processing

We process personal information on the basis of: (a) your free, specific, informed, and unambiguous consent (for example, when you sign up for a newsletter); (b) the certain legitimate uses recognised under Section 7 of the DPDP Act, such as processing personal data voluntarily provided by you for a specified purpose you have not objected to, or compliance with a legal obligation or judicial order; and (c) the necessity of processing to perform a contract with you (for example, fulfilling an order, event registration, or course enrolment).

We do not currently use the services of a registered Consent Manager. You may give, manage, review, or withdraw your consent, and exercise your other rights, directly with us using the contact details in Section 14.

The Website uses cookies and similar technologies (such as web beacons and local storage) to remember your preferences, understand how visitors use the Website, and improve your experience. We may use third-party analytics services (such as Google Analytics) that place their own cookies to help us understand usage patterns.

How We Share Your Information

For the purposes of the DPDP Act, JBPL acts as the Data Fiduciary in respect of all personal data processed through the Website, including personal data collected in connection with event and retreat registrations, and orders for books, SM Specials, SMExclusive and SM Courses. Where we engage service providers to process personal data on our behalf (Data Processors), we do so only under a valid contract requiring them to process personal data solely as instructed by us and to maintain appropriate security safeguards, in accordance with Section 8(2) of the DPDP Act.

We do not sell your personal information. We may share information with:

  • A third-party payment gateway, to complete transactions for orders, event registrations, and course purchases;
  • Service providers who assist us with shipping, email delivery, hosting, IT support, and analytics, under confidentiality obligations;
  • Event partners, host venues, or co-organizing institutions, solely for the purpose of coordinating the specific event you register for;
  • RGD, JKYog, and affiliated or related organizations under the broader RGD & JKYog mission (for example, Jagadguru Kripalu University, JKYog Naturopathy Hospital, Holy Bhagavad Gita, and Bhakti Store), which may operate independently and maintain their own privacy policies — we encourage you to review those policies separately if you interact with those websites;
  • Government authorities or regulators, where required by law, legal process, or to protect the rights, property, or safety of JBPL, RGD, JKYog, our users, or the public;
  • A successor entity in connection with a merger, reorganization, or transfer of assets, subject to equivalent privacy protections.

Third-Party Links and Embedded Content

The Website may contain links to third-party websites (including the affiliated websites listed above), embedded videos (for example, from YouTube), social media plugins, and app store links. This Privacy Policy does not apply to those third-party sites or services, and we encourage you to review their respective privacy policies before providing any personal information.

Data Retention

In accordance with the DPDP Act, we retain personal information only for as long as necessary to fulfil the specified purpose for which it was collected, or to comply with legal, accounting, or reporting obligations, resolve disputes, and enforce our agreements. Where retention is not required by law, we will erase personal information as soon as it is reasonable to assume the specified purpose is no longer being served, including where you withdraw your consent. When information is no longer required, we take reasonable steps to delete or anonymize it.

Data Security

In accordance with the DPDP Rules, we implement reasonable technical and organisational security safeguards to protect personal data against unauthorized access, alteration, disclosure, or destruction, including data security measures such as encryption or masking where appropriate, access controls, monitoring and logging to detect unauthorized access, and secure payment processing through our payment gateway. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Personal Data Breach Notification

In the event of a personal data breach, we will, to the best of our knowledge, notify you without delay through your registered email address, phone number, or other mode of communication you have provided to us, in a concise, clear, and plain manner, describing:

  • The nature, extent, and timing of the breach;
  • The consequences relevant to you that are likely to arise from the breach;
  • The measures we have implemented or propose to implement to mitigate the risk;
  • The steps you may take to protect your interests; and
  • The business contact information of a person able to respond to your queries.

We will also intimate the Data Protection Board of India of any personal data breach in accordance with the timelines and requirements prescribed under the DPDP Rules.

Your Rights

Subject to applicable law (including the DPDP Act and DPDP Rules, and, where applicable to visitors from other jurisdictions, laws such as the GDPR or CCPA), you may have the right to:

  • Obtain a summary of the personal data we process about you and the processing activities undertaken;
  • Obtain the identities of other Data Fiduciaries and Data Processors with whom your personal data has been shared by us, along with a description of the personal data so shared;
  • Request correction, completion, or updating of inaccurate or incomplete personal information;
  • Request erasure of your personal information, subject to our legal retention obligations;
  • Withdraw consent to processing (for example, unsubscribing from our newsletter) at any time, without affecting the lawfulness of processing prior to withdrawal;
  • Nominate another individual to exercise your rights under the DPDP Act in the event of your death or incapacity;
  • Lodge a grievance with our Grievance Officer (see Section 14) and, if unresolved, escalate the matter to the Data Protection Board of India.

To exercise any of these rights, please contact us using the details in Section 14. We will endeavour to respond to your request or grievance within ninety (90) days of receipt, in accordance with the DPDP Rules.

Children's Privacy

The Website and Services are intended for a general audience and are not directed at children under the age of 18. We do not knowingly collect personal information from children without verifiable consent of a parent or lawful guardian, as required under the DPDP Act and DPDP Rules. In line with the DPDP Act, we do not undertake tracking or behavioural monitoring of children, or direct targeted advertising at children. If you believe a child has provided us with personal information without appropriate consent, please contact us so that we may take appropriate action, including erasure of such information.

International Visitors and Cross-Border Data Transfer

JBPL operates the Website from India, and our servers and service providers may be located in India or other countries. The DPDP Act permits the transfer of personal data outside India except to countries or territories that the Central Government may restrict by notification from time to time; we do not currently transfer personal data to any such restricted jurisdiction. If you access the Website from outside India, your information may be transferred to, stored, and processed in India or other jurisdictions that may have data protection laws different from those of your home country. By using the Website, you consent to such transfer, storage, and processing.

If you have subscribed to our newsletter or opted in to receive promotional communications, you may unsubscribe at any time by clicking the “unsubscribe” link in any email or by contacting us directly. Please note that you may continue to receive transactional communications (such as order, course, or event confirmations) even after opting out of marketing communications.

Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles, and any disputes shall be subject to the exclusive jurisdiction of the competent courts at Cuttack, Odisha, India. This is without prejudice to the exclusive jurisdiction of the Data Protection Board of India over matters falling within the scope of the DPDP Act, in respect of which no civil court shall have jurisdiction as provided under Section 39 of the DPDP Act.
